1. Acceptance of Terms By creating an account and using the Swiirl Creator Portal, you agree to these terms and conditions, our Privacy Policy, and any additional terms that may apply. If you do not agree, please do not use our services.

2. Eligibility To register as a creator, you must be at least 18 years old. You must provide accurate information during registration and keep your account information up-to-date.

3. Account Responsibilities You are responsible for maintaining the confidentiality of your account and password. You agree to notify Swiirl immediately of any unauthorized use of your account.

4. Content Ownership and Licensing

Copyright Ownership: By uploading content, you confirm that you are the original creator and copyright owner of the content, and that you have the right to grant Swiirl the license to use your content as outlined in these terms.

The content you are uploading is not available for sale on any other platform.

The content has not been previously licensed to any other party.

Ownership: You retain ownership of the non-commissioned content you create and upload to Swiirl.

Licensing: By uploading content, you grant Swiirl's brand clients, who commission or purchase the content, a 2-year, worldwide, non-exclusive license to use, display, distribute, and promote your content in connection with their products and services. After the 2-year period, all rights revert back to you, the creator, unless a new agreement is made.

Rights to Modify: Swiirl reserves the right to modify, adapt, and create derivative works from your content to fit the needs of our brand clients.

5. Compensation

Commissioned Content: You will be compensated for your content according to the terms agreed upon for each project. Payment details and schedules will be provided separately.

Existing Non-Commissioned Creative: For any existing non-commissioned creative content that you choose to upload to Swiirl, you will be compensated at a rate of $250-$500 per piece if selected by a brand client.

6. Conduct and Content Standards

Appropriate Content: You agree not to upload content that is illegal, offensive, or infringes on any third party's rights.

Behavior: You agree to engage professionally and respectfully with other creators, school officials, and brand clients.

7. Termination Swiirl reserves the right to terminate your account at any time for any reason, including but not limited to violations of these terms and conditions.

8. Privacy Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Changes to Terms Swiirl may update these terms from time to time. We will notify you of any significant changes. Continued use of the platform constitutes acceptance of the new terms.

10. Limitation of Liability Swiirl is not liable for any direct, indirect, incidental, or consequential damages resulting from the use of our platform or services.

11. Governing Law These terms are governed by and construed in accordance with the laws of [Your Country/State]. Any disputes arising from these terms will be resolved in the courts of [Your Country/State].
