Schools/ Orgs

1. Content Uploads and Ownership

  • By uploading content to the Swiirl platform, your school or organization acknowledges that you have obtained all necessary rights and permissions to use, share, and distribute the content.

  • All uploaded content (apart from brand commissioned work product) remains the intellectual property of the original creator. However, by uploading, you grant Swiirl and its brand partners a non-exclusive, worldwide license to use, reproduce, distribute, and promote the content in accordance with these terms.

2. Creator Permissions

  • Schools and organizations are responsible for obtaining explicit consent from creators (students, faculty, or other individuals) before uploading their work to the platform.

  • It is your responsibility to ensure that each creator has reviewed and agreed to Swiirl's terms regarding content use and distribution.

3. Parental/Guardian Waivers

  • For creators under the age of 18, you must obtain a signed waiver from their parent or legal guardian, granting permission to use, share, and distribute their content on the Swiirl platform.

  • By uploading content created by minors, you confirm that you have obtained all necessary waivers and can provide proof of consent upon request.

4. Compliance and Content Standards

  • Schools and organizations must ensure that all content uploaded complies with Swiirl's content guidelines and community standards. Inappropriate, offensive, or copyrighted material without proper authorization is strictly prohibited.

  • Swiirl reserves the right to remove any content that violates these terms or applicable laws.

5. Usage Rights

  • Swiirl and its brand partners are granted the right to feature, promote, and license the content uploaded through the school or organization portal. Any licensing agreements made will be in line with the non-exclusive usage rights and as specified by the individual agreements with brands.

  • Usage of content by Swiirl’s brand partners will be subject to the agreed-upon terms, including but not limited to licensing periods, compensation, and crediting of creators.

6. Responsibility for Content Accuracy

  • Your school or organization is responsible for ensuring that all uploaded content is accurate, properly credited, and in compliance with these terms. Swiirl will not be liable for any issues arising from inaccurate or misrepresented content uploads.

7. Data Protection and Privacy

  • Schools and organizations must adhere to data privacy regulations when handling creator information, particularly for minors. Swiirl will process and store content and personal data in accordance with its Privacy Policy.

8. Disputes and Content Removal

  • In the event of a dispute regarding content ownership or consent, Swiirl reserves the right to remove the content in question until the matter is resolved. Schools and organizations must cooperate with Swiirl to address any claims of improper content use.

9. Updates to Terms

  • Swiirl may update these terms periodically. Schools and organizations will be notified of any changes, and continued use of the platform constitutes acceptance of the updated terms.

By uploading content to the Swiirl platform, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
